Domestic Arbitration - Model Clause

Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be referred for Institutional Arbitration and settled by arbitration in accordance with the rules of White Code VIA Mediation Centre Foundation as at present in force.

Both the parties have verified that White Code VIA Mediation Centre Foundation is a non profit organization and an impartial institution and authorize the appointment committee of White Code VIA Mediatiocn Centre Foundation to appoint sole Arbitrator or a panel of arbitrators.

The award of the Arbitrator shall be final and binding on the parties hereto and Arbitration shall be as per the provisions in force of the Arbitration & Conciliation Act, 1996.

The Arbitration shall be held in English language and the seat of Arbitration shall be in ____________, India.

International Arbitration - Model Clause

Mediation - Model Clause

The parties mutually agree that any dispute, controversy or claim arising out of or relating to this contract shall be referred to mediation at White Code VIA Mediation Centre Foundation under the institutions Rules as at present in force. In the event the parties are unable to resolve such dispute(s) within 14 days of commencement of the mediation, which time limit is extendable by mutual agreement, they will be free to resort to any other form of dispute resolution as is available to them. The Mediation shall be in English Language and the seat of the Mediation shall be in ________. The Mediation Panel shall consist of 1/3 mediator(s) to be appointed by White Code VIA Mediation Centre Foundation which is hereby authorized by both the parties and such appointment/nomination of mediator shall not be challenged on any grounds whatsoever.

MED-ARB - Model Clause

In case of any dispute, disagreement or claim arising between the parties concerning this agreement, the parties shall try to resolve the dispute by negotiation. Negotiation here means an invitation to be sent by one party to the other in writing for a meeting and an attempt by both, in the meeting, to resolve the dispute within 14 days from date of the written invitation or such other duration as may be agreed upon by both the parties in writing. If the dispute has not been resolved by such mediation, the same shall be shall be referred for Institutional Arbitration and settled by arbitration in accordance with the rules of White Code VIA Mediation Centre Foundation as at present in force.

ARB-MED-ARB - Model Clause

Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the White Code VIA Mediation Centre Foundation Rules (Arbitration Institution) as at present in force. The Arbitration shall be held in English language and the seat of Arbitration shall be in Bengaluru, India. The arbitrator(s) appointment and arbitration administration shall be by White Code VIA Mediation Centre Foundation which is hereby authorized by both the parties and such appointment/nomination of arbitrator or his award shall not be challenged on any grounds whatsoever. The award of the Arbitration through VIA Mediation Centre shall be final and binding on both the parties. The arbitrator(s) will pass a written and a reasoned award and will be entitled to award cost of the proceedings in accordance with the provisions of Arbitration and conciliation Act 1996 or any statutory amendment thereof.

It is further agreed that following the commencement of arbitration, the parties will attempt, in good faith to resolve such dispute, difference or controversy through mediation, as per the Arbitration and Conciliation Act, 1996 through a mediator/panel of mediators appointed by White Code VIA Mediation Centre Foundation. Any settlement reached in course of mediation shall be referred to the arbitral panel appointed through the Centre and may be made a consent award on agreed terms. Such award shall be final and binding on both the parties.

Existing Disputes - Model Clause

A dispute having arisen between the parties concerning A, B of _______________________________________ and X,Y of _______________________________________, hereby agree that the dispute shall be referred to and finally resolved by arbitration in accordance with the White Code VIA Mediation Centre Foundation Rules (Arbitration Institution) as at present in force. The Arbitration shall be held in English language and the seat of Arbitration shall be in Bengaluru, India. The arbitrator(s) appointment and arbitration administration shall be by White Code VIA Mediation Centre Foundation which is hereby authorized by both the parties and such appointment/nomination of arbitrator or his award shall not be challenged on any grounds whatsoever. The award of the Arbitration through VIA Mediation Centre shall be final and binding on both the parties. The arbitrator(s) will pass a written and a reasoned award and will be entitled to award cost of the proceedings in accordance with the provisions of Arbitration and conciliation Act 1996 or any statutory amendment thereof.
